Terms & Conditions

These Terms explain the rules for using WHAASS, including WhatsApp campaigns, templates, contacts, phone numbers, automation flows, billing, platform access, and related business communication services.

Your Agreement

By using WHAASS, you agree to follow these Terms and all applicable laws and platform rules.

WhatsApp Use

You are responsible for using campaigns, templates, contacts, and flows lawfully and with proper consent.

Safe Platform

We may suspend access for spam, misuse, fraud, policy violations, or harmful activity.

1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of the WHAASS platform and related services operated by WHAASS (“we”, “us”, or “our”). By accessing, registering for, or using WHAASS, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the services.

2. About WHAASS

WHAASS is a WhatsApp Business growth and communication platform that helps businesses manage WhatsApp campaigns, templates, contact lists, phone numbers, automation flows, customer replies, lead capture, and related business messaging workflows from one workspace.

3. Eligibility and Accounts

  • You must be legally capable of entering into a binding agreement in your jurisdiction.
  • You are responsible for keeping your login credentials secure and for all activity under your account.
  • You must provide accurate, complete, and current registration, business, billing, and contact information.
  • You must notify us promptly if you suspect unauthorized account access or security misuse.

4. Platform Features

WHAASS may provide features such as WhatsApp campaign creation, approved template usage, contact import, list management, phone number setup, automation flow building, lead tracking, dashboards, reporting, and customer communication tools. Features may change, improve, pause, or be removed from time to time based on business, technical, legal, or platform requirements.

5. WhatsApp and Meta Requirements

  • Your use of WhatsApp-related features must comply with Meta, WhatsApp, and WhatsApp Business Platform policies.
  • You are responsible for obtaining proper customer consent before sending messages, campaigns, templates, broadcasts, or automated replies.
  • You must not send spam, misleading messages, prohibited content, fraudulent offers, or communications that violate applicable law.
  • Template approval, message delivery, phone number verification, and messaging availability may depend on Meta or WhatsApp systems and policies.

6. Prohibited Conduct

  • Do not use WHAASS for spam, fraud, phishing, or impersonation.
  • Do not upload, send, or distribute illegal, harmful, infringing, abusive, deceptive, or misleading content.
  • Do not attempt to reverse engineer, scrape, overload, disrupt, or gain unauthorized access to WHAASS or connected systems.
  • Do not use the platform in a way that harms WHAASS, other users, customers, Meta/WhatsApp systems, or third-party services.
  • Do not bypass usage limits, billing controls, verification processes, or security protections.

7. User Content and Customer Data

You retain ownership of your business content, including templates, messages, flows, contacts, lists, uploaded files, customer data, and campaign content. You grant WHAASS a limited, non-exclusive license to host, process, transmit, display, and use this content only as needed to provide, secure, support, and improve the services. You are responsible for ensuring that your content and customer data are lawful and properly collected.

8. Plans, Payments and Billing

  • Paid plans, subscriptions, usage-based charges, setup fees, or add-ons may apply depending on your selected WHAASS plan.
  • Payment processing may be handled by third-party payment providers. Their terms and policies may also apply.
  • You are responsible for all applicable taxes, charges, fees, and billing information connected to your account.
  • If payment fails or your account remains unpaid, we may limit, suspend, or terminate access to paid features.
  • WhatsApp conversation charges, Meta fees, gateway fees, or other third-party charges may be separate from WHAASS subscription fees unless expressly stated otherwise.

9. Refunds and Cancellations

Refunds, cancellations, downgrades, and billing changes are handled according to the plan terms, merchant policy, and applicable law. Unless stated otherwise, fees already paid may be non-refundable. You should review your plan, usage limits, and billing details before purchasing or renewing a subscription.

10. Third-Party Services

WHAASS may connect with third-party services such as Meta, WhatsApp, payment gateways, hosting providers, analytics tools, email providers, and infrastructure services. We are not responsible for third-party outages, pricing changes, policy changes, errors, restrictions, or service interruptions. Your use of third-party services may be governed by their own terms and privacy policies.

11. Privacy

Your use of WHAASS is also governed by our Privacy Policy, which explains how we collect, use, protect, and share information related to your account, contacts, campaigns, flows, messages, billing, and usage of the platform.

12. Intellectual Property

WHAASS, including its software, user interface, workflows, branding, design, systems, features, documentation, and related materials, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, modify, distribute, resell, sublicense, reverse engineer, or create derivative works from WHAASS unless expressly permitted by us in writing.

13. Service Availability and Changes

We aim to provide a reliable service, but WHAASS may occasionally be unavailable due to maintenance, updates, system failures, third-party outages, infrastructure issues, security incidents, or events outside our control. We may modify, suspend, or discontinue any part of the service at any time where necessary.

14. Disclaimers

  • The services are provided “as is” and “as available”.
  • We do not guarantee that WHAASS will be uninterrupted, error-free, or suitable for every business purpose.
  • We do not guarantee WhatsApp template approval, message delivery, customer response, campaign performance, lead conversion, or third-party service availability.
  • To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, statutory, or otherwise.

15. Limitation of Liability

To the maximum extent permitted by law, WHAASS and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business, goodwill, data, customers, or opportunities arising from your use of or inability to use the services, even if we have been advised of the possibility of such damages.

16. Indemnity

You agree to defend, indemnify, and hold harmless WHAASS, its owners, affiliates, employees, contractors, and partners from any claims, damages, liabilities, losses, costs, or expenses arising from your use of the services, your content, your customer communications, your violation of these Terms, or your violation of applicable laws or third-party rights.

17. Suspension and Termination

We may suspend, restrict, or terminate your access to WHAASS if you breach these Terms, fail to pay fees, misuse the platform, create legal or security risk, violate WhatsApp or Meta policies, engage in suspected fraud or spam, or use the services in a harmful or unlawful way. Upon termination, your right to use the services will stop immediately.

18. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the “Last updated” date on this page. Continued use of WHAASS after changes are posted means you accept the updated Terms.

19. Governing Law and Contact
